Discussing The Recent Amendments to the Law A Professor at UoB Publishes a Book on the Bahraini Civil and Commercial Procedures Law

The University of Bahrain (UoB) published a book on private law by Prof. Dr. Najib Ahmed Al-Jabali, Professor of Procedure and Arbitration Law at the University’s College of Law, in which he discussed the latest amendments to the law in the Kingdom of Bahrain.

The book – which came under the title: “Bahrain Civil and Commercial Procedure Law” – came in accordance with the Bahraini Procedure Law No. (12) of 1971 and its amendments, and it reviews a study of the general principles of judiciary and litigation, jurisdiction and competence, claims and their uses, in addition to litigation, procedural work, judgment, methods of appeal, and orders.

Moreover, the book focuses on the amendments that affected the Procedure Law No. (12) of 1971, which is considered one of the oldest procedural laws in the Arabian Peninsula. This law has affected recent amendments that are in line with life developments, especially those related to electronic litigation procedures.

The book included an explanation of the most important amendments, with reference to some Islamic legislation and the opinion of Islamic jurisprudence, and it documented the opinions attributed to its authors in the margins, to serve as a reference for students, those who are interested, and specialists.

Additionally, the book focused on procedural work, procedural penalty, and the effects of procedural spoil, and ways to reduce it, explaining the basic features of the principles of courts and litigation, the most important of which is the principle of confrontation, which the judge must monitor in all stages of litigation, as well as reviewing the theory of state work and judicial orders.

The book – which was printed at UoB’s Press – is of medium size and has 463 pages divided into six chapters. It is a textbook approved by the Deanship of Graduate Studies and Scientific Research at UoB.

It is worth noting that Dr. Al-Jabali holds a Ph.D. in Civil Procedure Law from Alexandria University in 1996, as well as a Master’s degree in 1987, and a Bachelor’s degree in Law in 1983 from Sana’a University.

Dr. Al-Jabali has also published several books, including: the book “Arbitration Award in Bahraini Law: A Procedural Study in the Light of the Bahraini Arbitration Law No. 9 of 2015”, the book “Expedited Enforcement in Bahraini Law”, the book: “The General Theory of Arbitration: A Comparative Study of Islamic Jurisprudence”, the book “The Mediator in the Law of Procedures”, and the book “The Mediator in Forced Execution: A Study of Direct and Indirect Execution”.
